The Rehfuss Law Firm successfully defended a municipal client and several police officers in a claim alleging assault, improper and insufficient training and improper supervision. The plaintiff had alleged that a co-employee police officer had pointed a loaded weapon at her while she was sitting at her desk. On a motion for summary judgment, the Court dismissed the claim on the basis that the plaintiff had made an election of remedies and that Workers’ Compensation was her sole and exclusive remedy. This case involved the novel issue of the interplay of Workers’ Compensation and horseplay in a work environment.
