The plaintiff, a club/bar owner in the City of Albany, brought a First Amendment claim challenging the City’s cabaret law on the grounds that it was vague, arbitrary and quelled the free speech rights of the club. Stephen Rehfuss vigorously defended the rights of the City and was able to show that the cabaret law, fashioned after the cabaret law in New York City, had withstood constitutional challenges. Prior to the completion of discovery, and with a motion to dismiss pending, the plaintiff discontinued its claim with prejudice against the City.
