This case stemmed from an incident in which the Plaintiff lost a provisional promotion after being observed outside a Dunkin’ Donuts location in the early hours of January 31, 2019, exhibiting signs of intoxication. Despite his arguments, the Plaintiff failed to demonstrate that discrimination played a role in the decision to revoke his promotion and the case was dismissed by the District Court. Plaintiff appealed the decision.
